Idaho Alimony Law: Eligibility & the Spousal Maintenance Standard

Idaho law uses the term spousal maintenance in its statutes, though alimony, spousal support, and spousal maintenance all carry the same legal meaning. The governing statute is Idaho Code Section 32-705, and it sets a two-part eligibility test. A spouse seeking maintenance must demonstrate both that they lack sufficient property to provide for their reasonable needs and that they can’t support themselves through employment. Both prongs must be satisfied. A spouse who can meet their needs through work may not qualify, which makes Idaho’s standard more restrictive than many other states.

Maintenance is gender-neutral in Idaho. Either spouse may petition for support regardless of who earned more during the marriage. Courts have broad discretion in deciding whether to award maintenance and in setting the amount and duration. There’s no fixed formula, which means the specific facts of each case drive the outcome.

Types of Spousal Support in Idaho

Idaho recognizes three forms of spousal maintenance, each serving a different purpose in the divorce process.

Temporary Support

Temporary support, sometimes called pendente lite (“while the litigation is pending”), may be ordered while divorce proceedings are ongoing. It helps the requesting spouse cover basic living expenses until the final decree is entered, at which point it ends.

Rehabilitative Support

Rehabilitative support is the most common type awarded in Idaho and throughout the Treasure Valley. It gives the receiving spouse time and financial assistance to obtain education, training, or employment so they can become self-supporting. Courts typically expect the receiving spouse to present a realistic plan for reaching financial independence.

Permanent Support

Permanent support is rarely awarded. It’s generally reserved for long-term marriages or situations where the receiving spouse can’t become self-supporting due to age, serious illness, or disability. Despite the name, it ends if the receiving spouse remarries or dies, and it can be modified if circumstances change significantly.

Factors Ada County Courts Consider When Setting Alimony

Because Idaho has no guideline calculation for spousal maintenance, judges weigh the specific facts of each case. Idaho Code Section 32-705 identifies the factors courts must consider, including:

• The financial resources of the spouse seeking maintenance, including property awarded in the divorce
• The time necessary to acquire sufficient education and training to find employment
• The length of the marriage
• The age and physical and emotional condition of the spouse seeking maintenance
• The paying spouse’s ability to meet their own needs while providing support
• The tax consequences to each spouse
• Fault on either spouse’s part during the marriage

On the fault question: a spouse found to have committed adultery is less likely to receive maintenance, while fault on the paying spouse’s part can weigh in favor of an award. On taxes: for divorces finalized after December 31, 2018, the Tax Cuts and Jobs Act changed how spousal support is treated. Payments are no longer deductible for the paying spouse and aren’t treated as taxable income for the receiving spouse.

Modifying or Enforcing a Spousal Maintenance Order

Circumstances change after a divorce is finalized, and Idaho law provides a process for addressing that. A maintenance order may be modified, but only as to payments due after the modification motion is filed. The spouse seeking the change must show a substantial and material change in circumstances since the last order was entered.

Situations that may support a modification request include significant job loss, serious illness, retirement, a substantial increase in the receiving spouse’s income, or the receiving spouse entering a cohabiting relationship. Remarriage of the receiving spouse typically ends alimony automatically. Cohabitation alone doesn’t trigger automatic termination under Idaho law, but it can be raised as a change of circumstances. One important limit: if the original divorce agreement made the maintenance award non-modifiable, that agreement controls, and modification isn’t available regardless of what has changed.
