What Idaho’s Advance Directive Covers

Idaho’s advance directive is a single document with two distinct parts, each serving a different purpose in your incapacity planning.

The Living Will Section

This part of the document records your preferences for life-sustaining treatment if you become terminally ill or permanently unconscious. You can specify your wishes regarding CPR, ventilator use, artificial nutrition and hydration, and comfort care. Having these preferences documented means your medical team has direct guidance rather than relying on family members to reconstruct your wishes under pressure.

The Durable Power of Attorney for Healthcare Section

This section lets you name a healthcare agent, a trusted person authorized to speak on your behalf and make medical decisions when you’re unable to do so. Idaho law prohibits naming certain individuals as your agent, including your treating healthcare provider, a nonrelative employee of your treating healthcare provider, or an operator or nonrelative employee of a community care facility. Choosing the right person and giving them clear authority is one of the most consequential decisions in the document.

Any competent person aged 18 or older in Idaho can execute an advance directive. Idaho also maintains the Idaho Healthcare Directive Registry through the Department of Health and Welfare, which allows voluntary registration so healthcare providers can access your document when it’s needed.
