Are handwritten wills legal in Idaho?

Short answer: Yes - Idaho recognizes holographic wills if the signature and material provisions are in your own handwriting (Idaho Code § 15-2-503). These are legal, however, we generally find that these bring up unnecessary problems.

Idaho is friendlier to informal wills than many states. A holographic will needs no witnesses at all: if the substantive terms and the signature are in the testator's handwriting, it can be probated. Idaho also honors out-of-state wills executed under the other state's rules (§ 15-2-506), and an interested witness - a beneficiary who also witnessed - does not invalidate anything (§ 15-2-505).

Why probate lawyers love holographic wills (professionally speaking):

  • They omit essentials: no alternate beneficiaries, no personal representative, no guardian nomination, no statement revoking earlier wills.
  • They use ambiguous language that forces court interpretation - 'I leave the house to the kids' invites litigation over which house, which kids, in what shares.
  • They're hard to prove. A formal will with a self-proving affidavit (§ 15-2-504) sails through probate; a handwritten note requires proving the handwriting, sometimes against skeptical relatives.
  • They're usually written in crisis - late-life, hospital-bed circumstances that are also prime conditions for capacity and undue-influence challenges.

The formal requirements are not hard to meet: a will is valid in Idaho if it's in writing, signed by you (or at your direction in your presence), and signed by two witnesses who watched you sign or heard you acknowledge it (§ 15-2-502). Any adult of sound mind - including emancipated minors - can make one (§ 15-2-501).

If a handwritten will is all a loved one left, don't assume it's worthless - Idaho probate courts accept them regularly, and we can assess yours.
